3rd Bay Outpost

These Terms of Service ("Terms") govern your access to and use of the 3rd Bay Outpost website, applications, and services (collectively, the "Platform").

The Platform is operated by 3rd Bay Labs, LLC, an Idaho limited liability company, doing business as 3rd Bay Outpost ("3rd Bay Outpost," "Company," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.


1. Definitions

  • User means any individual or entity that accesses or uses the Platform.
  • Owner means a User who lists Equipment on the Platform for rental.
  • Renter means a User who rents or otherwise takes possession or control of Equipment through the Platform.
  • Equipment means any gear, vessels, trailers, accessories, or related items listed on the Platform.
  • Booking means a reservation made through the Platform.
  • Rental means the temporary transfer of possession or control of Equipment from an Owner to a Renter.
  • Damage Protection Plan means a contractual damage waiver, not insurance, that may reduce or waive certain financial responsibility otherwise owed by a Renter for eligible accidental physical damage, subject to applicable Plan Terms, exclusions, deductibles, documentation requirements, and claim review procedures.
  • Content means text, images, listings, messages, reviews, and other materials posted on the Platform.
  • Rental Agreement means the transaction-specific agreement between the Owner and Renter generated upon Booking confirmation.
  • Equipment Condition Report means the pre-rental condition documentation required under these Terms in connection with each Booking.
  • Listing Documentation means the equipment photos, condition rating, description, and itemization as published on the Platform at the time of Booking confirmation.

2. Platform Role and Limitations

Marketplace Facilitator Only

3rd Bay Outpost is a technology platform that connects Owners and Renters. We do not own, inspect, store, transport, maintain, repair, or operate any Equipment listed on the Platform.

No Party to Rentals

We are not a party to any Rental agreement between an Owner and a Renter. Any Rental is solely between the Owner and the Renter.

No Endorsement or Verification

We do not endorse, certify, guarantee, or verify:

  • any User
  • any Equipment
  • any listing description
  • any User's skills, experience, or compliance with laws

No Insurance Services

Except as expressly described in an applicable Damage Protection Plan, 3rd Bay Outpost does not provide insurance, act as an insurance carrier, broker, agent, adjuster, or underwriter, and does not guarantee payment of any claim, damage, loss, theft, repair cost, replacement cost, or other expense arising from a Rental.


3. Eligibility and Accounts

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.

Account Registration

You agree to provide accurate, complete, and current information and to maintain the security of your account credentials.

No Background Checks

Unless stated otherwise, we do not perform background checks or safety certifications of Users.


4. Equipment Listings (Owners)

Owners represent and warrant that:

  • they have the right to list the Equipment
  • listing descriptions are accurate
  • Equipment is lawful to rent and not stolen
  • they comply with all applicable laws

Owners are solely responsible for their Equipment.


5. Bookings and Payments

Payments are processed through third-party payment processors. 3rd Bay Outpost does not store full payment card details.

We may charge service fees, which are disclosed at checkout.


6. Rental Agreement and Equipment Condition Report

6.1 Binding Effect of Rental Agreement

Upon Booking confirmation, both the Owner and Renter are automatically bound by the terms of the 3rd Bay Outpost Rental Agreement, which is incorporated into these Terms by reference. A Rental Agreement document will be sent to both parties for electronic signature. Receipt of that document is a courtesy — the terms of the Rental Agreement apply upon Booking confirmation whether or not either party separately signs the document.

6.2 Equipment Condition Report Requirement

If a Damage Protection Plan was purchased in connection with a Booking, both the Owner and Renter are required to complete an Equipment Condition Report prior to that Rental. The Equipment Condition Report will be sent to the Owner prior to the Rental start date. The Owner must complete their portion before the document is routed to the Renter for acknowledgment and signature at or before the time of handoff.

By accepting these Terms, you acknowledge and agree that:

  • Completion of the Equipment Condition Report is a required obligation under these Terms
  • The Equipment Condition Report serves as the agreed baseline condition record for the Rental and may be referenced in the event of a damage dispute or Damage Protection Plan claim
  • Your obligation to complete the Equipment Condition Report is not waived by failure to receive, open, or act on the document sent to you

6.3 Default Condition Record

If the Equipment Condition Report is not completed and signed by both parties prior to the commencement of the Rental period, the Listing Documentation shall automatically serve as the agreed-upon baseline condition record for that Rental. Both parties acknowledge that by proceeding with the Rental without a completed Equipment Condition Report, they accept the Listing Documentation as the evidentiary baseline for any damage dispute arising from that Rental.

6.4 Consequences of Failure to Complete

Failure to complete the Equipment Condition Report does not void either party's obligations under the Rental Agreement or these Terms. The following consequences apply:

  • An Owner who proceeds with the Rental without completing the Owner portion of the Equipment Condition Report waives the right to claim damage against the Renter for any condition not visible in the Listing Documentation at the time of Booking.
  • A Renter who proceeds with the Rental without completing the Renter portion of the Equipment Condition Report waives the right to dispute any damage claim made by the Owner that is consistent with damage occurring during the Rental period, as determined by comparison to the Listing Documentation at the time of Booking.
  • If a Damage Protection Plan was purchased, claim eligibility in the absence of a signed Equipment Condition Report is subject to the sole discretion of the applicable Damage Protection Plan administrator and is not guaranteed. 3rd Bay Outpost will submit the Listing Documentation as the baseline record in such cases but makes no representation that this will be sufficient for claim approval.

6.5 Mandatory Inspection

Renters are solely responsible for inspecting all Equipment before transport and use, including:

  • trailers, tires, bearings, lights, and hitches
  • frames, valves, oars, safety gear
  • any component that could affect safety or performance

6.6 Acceptance of Condition

Use or transport of Equipment means the Renter accepts the Equipment "AS IS," subject to any disputes documented in a completed Equipment Condition Report.

6.7 Failure to Inspect

Failure to inspect or identify issues before use constitutes Renter negligence.


7. Assumption of Risk

You acknowledge that river recreation, boating, trailering, and outdoor activities are inherently dangerous.

Risks may include:

  • serious injury or death
  • property damage
  • equipment failure
  • road or water hazards
  • user error

You assume all risks associated with use and transport of Equipment.


8. Release of Liability

To the maximum extent permitted by law, you release and discharge:

  • 3rd Bay Labs, LLC
  • 3rd Bay Outpost
  • their members, managers, employees, agents, and affiliates

from any claims, damages, losses, or liabilities arising from:

  • use or transport of Equipment
  • any Rental
  • interactions with other Users

9. Indemnification

You agree to defend, indemnify, and hold harmless 3rd Bay Labs, LLC d/b/a 3rd Bay Outpost from all claims, damages, losses, costs, or expenses (including attorneys' fees) arising out of:

  • your use of the Platform
  • your Rental or listing of Equipment
  • your failure to inspect Equipment
  • your failure to complete the Equipment Condition Report
  • injury or damage to third parties

10. Damage, Loss, and Responsibility

Renters are responsible for:

  • damage beyond normal wear and tear
  • loss or theft of Equipment
  • late returns
  • replacement costs per Owner or Platform policies

This responsibility applies regardless of whether the Renter signed the Rental Agreement or completed the Equipment Condition Report. Acceptance of these Terms at account creation constitutes acknowledgment of this financial responsibility in connection with any Booking made through the Platform.

Continuing Liability

A Renter's responsibility for damage, loss, theft, late returns, repair costs, replacement costs, and related obligations exists independently of any Damage Protection Plan and applies regardless of whether a Damage Protection Plan was purchased for a particular Rental.


11. Damage Protection Plan

11.1 What It Is

The Damage Protection Plan is a contractual damage waiver and not insurance. It does not provide liability insurance, personal injury coverage, property insurance, marine insurance, casualty insurance, or any other form of insurance coverage. Purchase of the Damage Protection Plan does not guarantee approval of any claim, payment of any amount, or waiver of any liability.

11.2 Requirement

Certain Equipment may require purchase of the Damage Protection Plan based on replacement value, Equipment type, rental duration, risk characteristics, or other factors determined by 3rd Bay Outpost.

11.3 Condition Report Requirement for Claims

A completed Equipment Condition Report may be required as part of the claim review process. Additional documentation may also be required, including photographs, videos, repair estimates, invoices, communications between users, witness statements, or other information reasonably requested by 3rd Bay Outpost.

11.4 Exclusions

The Plan does not cover:

  • normal wear and tear
  • cosmetic damage
  • mechanical failure
  • negligence or misuse
  • failure to inspect
  • improper transport or loading

11.5 Claims and Determinations

Submission of a claim does not guarantee approval, payment, reimbursement, liability waiver, or any particular outcome.

3rd Bay Outpost retains sole discretion to evaluate submitted documentation, determine eligibility under the Damage Protection Plan, interpret Plan Terms, determine repairability, assess replacement value, apply exclusions, and resolve claims.


12. Content and Reviews

You grant a non-exclusive, royalty-free license to use Content you post.

Do not post unlawful, misleading, or defamatory material.


13. Termination

We may suspend or terminate accounts at our sole discretion to enforce these Terms or protect the Platform.


14. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied.


15. Limitation of Liability

To the maximum extent permitted by law, our total liability cannot exceed the greater of $100 or the fees you paid to us in the last 12 months.

We are not liable for indirect, incidental, or consequential damages.


16. Governing Law and Venue

These Terms are governed by the laws of Idaho.

Any legal action must be brought in Idaho courts, unless mandatory law requires otherwise.


17. Changes to Terms

We may modify these Terms at any time. Continued use means acceptance of revised Terms.
